- Primero. DECRETASE la nulidad, por violación al debido proceso, de todo lo actuado, a partir del auto de Marzo 22 de 2.006, inclusive, dictado por el Juzgado 33 Penal del Circuito de Bogotá, mediante el cual remitió la actuación a los Jueces Municipales de ese mismo Distrito Judicial, dentro de la ACCION DE TUTELA interpuesta por Carlos Andrés Wilches Carrillo contra el Ministerio de Defensa Nacional y el Hospital Militar Central Dirección General Subdirección Administrativa.
- Segundo. Como consecuencia de la anterior declaración, remítase el expediente al Tribunal Superior del Distrito Judicial de Bogotá, Sala Penal, para que adelante la actuación correspondiente a la acción de tutela presentada en este caso.
